Probate
When a loved one passes away, someone will be responsible for managing their affairs and their estate. Probate is the legal process that generally is completed to distribute the property. In Arizona, there are different types of probate based on the specifics of each person. Getting the assistance of an experienced probate attorney is important. At Desert View Law, we are here to help. Our probate administration process is tailored to help us learn about your needs and provide legal guidance during this difficult time.
Our Arizona Probate lawyers offer a free 30-minute consultation to discuss how we can assist you. You will discuss the details of the deceased person’s property and debts, as well as any other relevant information. The attorney will answer your questions and advise you on the next steps needed.
Whether or not the deceased person has a Will, there is still work to be done! The Personal Representative needs to be formally appointed through the Court. When there is not a Will, Arizona statutes will designate the heirs. If there is a Will appointing a Personal Representative, all the heirs must agree to that person. The probate attorneys at Desert View Law will work with your family and the Court to ensure the process is smooth and efficient. Once a Personal Representative is appointed, there are certain notification requirements for creditors to make any claims against the estate. Once the proper notice has been given and time has passed, the debts must be paid and assets distributed in accordance with the instructions outlined in the decedent’s will or trust. Once this has been successfully completed, it must be verified by a court-appointed fiduciary representative. One of our Phoenix probate attorneys will then have the courts verify completion of the required probate tasks and close probate.
The legal process of handling a loved one’s affairs can be daunting and overwhelming. But it does not have to be. Whether you are located in Tucson or Phoenix, a Desert View Law probate attorney will take time to answer your questions and concerns in a compassionate and understanding manner and walk you through the process.
